How Filing Bankruptcy Can Reinstate Your Driver’s License

If you have been involved in an auto accident and sued by the other driver’s insurance company, if a judgement is entered against you that you are unable to pay, the insurance company’s attorney can request that the Florida Dept. of Motor Vehicles (DMV) suspend your license.

As long as the stay is in effect, creditors cannot bring or continue lawsuits against the person or their property, make wage garnishments or continued collection attempts including making phone calls demanding payment.

So long as you include the car accident and the insurance company in your list of debts, you can have your driver’s license reinstated through bankruptcy. The only condition is that your license be eligible for reinstatement. For example, if you did not have car insurance before the accident you will have to show proof of insurance before your license will be eligible for reinstatement.
